Notice of Nondiscrimination
Applicants for admission and employment, students, parents of elementary and secondary school students, employees, sources of referral of a applicants for admission and employment, and all unions or professional organizations holding collective bargaining or professional agreements with Unified School District #438 are hereby notified that this institution does not discriminate on the basis of race, color, national origin, sex, age, or handicap in admission or access to, or treatment or employment in, its programs and activities. Any person having inquiries concerning Unified School District #438 compliance with the regulations implementing Title VI, Title IX, or Section 504 is directed to contact The Superintendent, Skyline Schools, (620) 672-5651. The Superintendent   has been designated by Unified School District #438 to coordinate the institution’s efforts to comply with the regulations implementing Title VI, Title IX, and Section 504. Any person may also contact the Assistant Secretary for Civil Rights, U.S. Department of Education, regarding the institution’s compliance with the regulations implementing Title VI, Title IX, or Section 504.

Asbestos – Notice to School Employees, Parents, and Students
In accordance with EPA regulations, the following school buildings: Skyline Schools and the Press box have been inspected for materials which contain asbestos and an asbestos Management Plan has been developed and adopted. Please refer to the Inspection and Management Plan to determine the type of asbestos-containing building materials (ACBM) found in all buildings, if any.

A copy of the Inspection and Management Plan (Part A and Part B) are on file with the Asbestos Program Manager, Central Administrative Office, Skyline Schools, 20269 W. Highway 54, Pratt, KS. This document complies with the AHERA mandated requirements for asbestos materials in school, including the results of inspections, the schedule for periodic surveillance every six months, the schedule for certified reinspection every three years and the schedule of response actions and post response actions if any friable asbestos containing materials was found.

Friable (crumbled by hand pressure) asbestos containing materials (ACM) may cause health problems; therefore, it is very important to avoid disturbing friable ACM. With the adoption of the AHERA Inspection/Management Plan, the local education agency is undertaking considerable effort and expense to protect the public health and safety. Your cooperation in this effort is needed and appreciated.

Family Educational Rights and Privacy Act
Under the provisions of the Family Educational Rights and Privacy Act (FERPA), parents of students and eligible students (those who are 18 or older) are afforded various rights with regard to educational records, which are kept and maintained by USD #438. In accordance with FERPA, you are required to be notified of those rights, which include:

1. The right to prevent disclosure of personally identifiable information contained in your educational records to other persons with certain limited exceptions. Disclosure of information from your educational records to other persons will occur only if:

a. we have your written prior consent for disclosure.

b. the information is considered “directory information” and you have not objected to the release of such information; or

c. disclosure without your prior consent is permitted by law. Including:

1. The district may disclose, without your consent, personally identifiable information to school officials with a legitimate educational interest.

2. The district shall disclose, without your consent, education records to officials of another school district in which a student seeks to enroll or intends to enroll.

3. The right to file a complaint with the Family Policy Regulations Office at the U.S. Department of Education if you believe that USD #438 has  failed to comply with FERPA’s requirements. The address of this office is 400 Maryland Ave. SW, Room 4074, Washington D.C. 20202-4605.

4. The right to obtain a copy of USD #438 policies for complying with FERPA.  A copy may be obtained from The Superintendent or Board Clerk , 20269 W. Highway 54, Pratt, KS 67124.

5. Identifiable student images shall not be posted on district or school websites without prior written permission from the student, and if under 18, the student’s parent or guardian. The mailing address, telephone or other personally identifiable information about any student shall not be posted on d district or school websites. All applicable requirements of the Family Educational Rights and Privacy Act (FERPA) shall be followed.

Temporary Disabilities
Homebound instruction will be made available to students with temporary disabilities, which prevent their attendance at school. Such homebound instruction shall require medical certification from a licensed physician who has consulted with the school nurse. This certification shall validate the medical necessity of homebound instruction. The school reserves the right to require an independent medical certification at district expense.

Homebound instruction will be made available to students with temporary disabilities only in classes where this type of instruction is appropriate. Every effort will be made to help the student progress normally through the required course of study. A homebound study program will be developed by the counselor, school nurse, classroom teacher and principal after certification of the disability.

The district may require a student to provide medical certification from a licensed physician that the student is physically and emotionally able to continue participation in the normal educational program or activity, including extra-curricular activities.

Pregnancies are considered temporary disabilities.

Racial and Disability Harassment
Racial harassment is unlawful discrimination on the basis of race, color or national origin under Title VI and VII of the Civil Rights Act of 1964, and the Kansas Acts Against Discrimination. Disability harassment is unlawful discrimination on the basis of disability under Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act. All forms of racial or disability harassment are prohibited at school, on school property, and at all school-sponsored activities, programs or events. Racial or disability harassment against individuals associated with school is prohibited, whether or not the harassment occurs on school grounds. USD #438 policies include definitions of racial and disability harassment and instructions for employees or students who wish to file a complaint of racial or disability harassment. All victims of racial or disability harassment and persons with knowledge of such harassment are encouraged to report the harassment immediately. Confidentiality will be maintained throughout the investigation of a complaint. Policies can be viewed at the USD #438 Central Office.

Students that feel they have been discriminated against should contact their building principal or the Superintendent.

Complaints of discrimination by employees should be addressed to an employee’s supervisor or the building principal or the compliance coordinator. Complaints against the superintendent should be addressed to the board of education.

Sexual Harassment
Sexual harassment is unlawful discrimination on the basis of sex under Title IX of the Education Amendments of 1972, Title VII of the Civil Rights Act of 1964, and the Kansas Acts Against Discrimination. All forms of sexual harassment are prohibited at school, on school property, and at all school -sponsored activities, programs or events. Sexual harassment against individuals associated with the school is prohibited, whether or not the harassment occurs on school grounds. USD #438 policies include definitions of sexual harassment and instructions for employees or students who wish to file a complaint of sexual harassment. All victims of sexual harassment and persons with knowledge of such harassment are encouraged to report the harassment immediately. Special Education
The South Central Kansas Special Education Cooperative (SCKSEC) is a special education school district organized to provide services to children who have mental retardation, specific learning disabilities, hearing, vision, language, or speech impairments, or severe multiple disabilities or for the gifted. It serves fifteen unified school districts in seven counties. (Barber, Comanche, Harper, Kingman, Kiowa, Pratt and Stafford). The main office is located in Pratt.
